End User License Agreement (EULA)

This End User License Agreement (the "Agreement") is between you and the developer and publisher of framepacer, operating publicly under the name pacerio (the "Developer," "we," or "us"). The "Software" means framepacer and its updates. By installing, purchasing, launching, or using the Software, you agree to this Agreement. If you do not agree, do not use the Software.
1. License Grant
Subject to this Agreement and any applicable Steam terms, the Developer grants you a personal, non-exclusive, non-transferable, revocable, and limited license to install and use the Software on devices owned or controlled by you for personal, non-commercial use. The Software is licensed, not sold.
2. Operation and Permissions
framepacer interacts with compatible games and Windows system features to provide frame pacing. It may request administrator approval, use Steam for license checks, and start with Windows only if you enable that option. You authorize these actions on devices you own or control.
3. Restrictions on Use
You agree not to, and you will not permit others to:
- Sell, rent, lease, sublicense, redistribute, host, or otherwise commercially exploit the Software or your license.
- Modify, disassemble, decompile, or reverse engineer the Software, except to the limited extent applicable law expressly permits despite this restriction.
- Bypass or interfere with ownership checks, security features, technical restrictions, or access controls.
- Use the Software unlawfully, maliciously, or on a device or process you are not authorized to control.
4. Updates
Steam or the Developer may make updates available, and Steam may install them automatically under your Steam settings. Updates may add, change, or remove features needed for compatibility, security, or operation. An updated "Last updated" date will identify changes to this Agreement. Material changes apply only as permitted by applicable law.
5. Steam, Games, and Anti-Cheat Services (IMPORTANT)
Steam, games, and anti-cheat services have their own terms and policies. Because framepacer interacts with running games, anti-cheat or security software may treat it as unauthorized. You are responsible for checking each game's rules. To the maximum extent permitted by law, the Developer is not responsible for bans, restrictions, lost access, or other third-party enforcement decisions.
6. Privacy and Local Files
The Software keeps limited information locally and does not automatically send telemetry or crash reports to the Developer. Steam and website features may communicate with third parties. See the Privacy Policy.
7. Intellectual Property and Third-Party Components
The Software and its original code, branding, interface, and assets are owned by the Developer or applicable licensors. The Software also includes third-party and open-source components that remain owned by their respective authors and are governed by their own license notices. This Agreement does not transfer ownership of the Software or those components to you.
8. Termination
This Agreement continues until terminated. You may terminate it by stopping use and uninstalling all copies of the Software. Your license ends automatically if you materially violate this Agreement. When the license ends, you must stop using and remove the Software. Terms that by their nature should continue—including ownership, warranty disclaimers, liability limits, and mandatory-law provisions—survive termination.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR BE COMPATIBLE WITH ALL HARDWARE AND SOFTWARE CONFIGURATIONS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS, INCLUDING LOSS OF PROFITS, DATA, GAME ACCESS, DIGITAL ITEMS, OR USE, ARISING FROM THE SOFTWARE OR YOUR INABILITY TO USE IT. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
11. Consumer Rights and Disputes
Nothing in this Agreement removes consumer rights, remedies, or protections that applicable law does not allow you to waive. Any governing law, court, or dispute forum will be determined under the mandatory law and ordinary conflict-of-law rules that apply to the particular dispute. This Agreement does not require you to give up mandatory protections available where you live.
12. Changes and Contact
We may update this Agreement when the Software, distribution method, or legal requirements change. The current version will be posted on this page with a revised date. Questions about this Agreement may be sent to pacerio@framepacer.com.
